The musician was charged with one count of DWI and two citations following his June arrest; his attorney spoke to reporters after Friday’s court hearing

Over a month after his arrest in Sag Harbor, N.Y. on a charge of driving while intoxicated or impaired, the case appeared before a judge on July 26, with Timberlake’s attorney Edward Burke Jr. asking for it to be dismissed outright, citing signing errors allegedly made by the arresting officer, PEOPLE confirms.
Sag Harbor Village Justice Carl Irace agreed to review Burke’s motion, but ruled Timberlake will be re-arraigned on the misdemeanor again next Friday, Aug. 2, this time with the correct documents.
The *NSYNC alum, who is currently in Europe amid his ongoing Forget Tomorrow World Tour, was not in court Friday, but will be required to appear virtually for the next hearing on Aug. 2. The case was heard hours before Timberlake, 43, kicked off his concert in Kraków, Poland, with a second show on Saturday.
Speaking to reporters following the hearing, Burke told WABC and other outlets, “He was not intoxicated. I’ll say it again. Justin Timberlake was not intoxicated. And we are very confident that charge — that criminal charge — will be dismissed.”
In a later statement obtained by CNN, Burke expanded on his remarks. “The most important fact to know about this case is that Justin was not intoxicated and should not have been arrested for DWI. The police made a number of very significant errors in this case.”
He continued, “Justin respects law enforcement and the very important job that they do. He cooperated with the police officers at all times and treated them with the respect they deserve. He also respects the entire judicial process including the District Attorney and Judge who were in court today. But the fact remains, he was not intoxicated and they made an error in arresting him for it. We are confident that this charge will be dismissed.”

Timberlake’s hearing comes several weeks after his arrest — when he was charged with one count of DWI and two citations, one for running a stop sign and one for failure to keep in lane.
Following his arrest and being held overnight, Timberlake was arraigned at the Sag Harbor Village Justice Court before being “released on his own recognizance.”
An arrest report obtained by PEOPLE noted that an officer claimed the musician “performed poorly on all standardized field sobriety tests” and that Timberlake told authorities he “had one martini and I followed my friends home.”

In a statement on June 19, the Justified singer’s attorney Burke said he “looks forward to vigorously defending Mr. Timberlake against these allegations” and that Timberlake “will have a lot to say at the appropriate time.”
At his Chicago concert at the United Center on June 21, Timberlake told fans “it’s been a tough week” in a short speech before performing “Selfish.”
“I know sometimes I’m hard to love but you keep on loving me and I love you right back,” he added as concertgoers cheered.
A source has since told PEOPLE on June 27 that Timberlake and his wife, Jessica Biel, “have faith in their legal team and continue to focus on work and their family instead.”
“They’re always supportive of each other’s careers,” the source added. “Jess would never miss a show when she’s able to attend. She’s excited for him. They’ve moved on from the arrest.”
